1. Agreement to Terms

By accessing or using Lyra (“Service”), provided by Digital Dream Works LLC (“DDW,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Lyra is an AI-powered voice operations platform that provides automated call answering, appointment scheduling, lead qualification, and related services for businesses. The Service operates 24/7 to handle incoming calls on behalf of subscribers.

3. Eligibility

You must be at least 18 years old and have the legal authority to bind your business to these terms. By using the Service, you represent that you meet these requirements.

4. Account Registration

To use the Service, you must provide accurate and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

5. Service Fees and Payment

• The Service is provided for a flat monthly fee of $700 as of the date of these terms.
• Fees are billed monthly in advance.
• All fees are non-refundable except as required by law.
• We reserve the right to change pricing with 30 days notice.
• Failure to pay may result in service suspension or termination.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Engage in fraudulent, deceptive, or misleading practices
• Transmit harmful, threatening, or abusive content
• Interfere with the operation of the Service
• Attempt to gain unauthorized access to systems
• Use the Service for illegal telemarketing or spam

7. AI Limitations

You acknowledge that the Service uses artificial intelligence which may occasionally make errors or provide inaccurate information. We continuously work to improve accuracy, but you are responsible for reviewing call summaries and correcting any errors. The AI is not intended to provide medical, legal, or emergency services advice.

8. Call Recording Disclosure

The Service records calls for quality assurance and service delivery. You are responsible for ensuring compliance with applicable call recording laws in your jurisdiction, including providing appropriate disclosures to callers if required.

9. Intellectual Property

The Service, including its software, designs, and content, is owned by DDW and protected by intellectual property laws. You are granted a limited, non-exclusive license to use the Service for your business purposes during your subscription.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DDW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, OR LOST DATA, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

12. Indemnification

You agree to indemnify and hold harmless DDW, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

Either party may terminate this agreement at any time. You may cancel your subscription by contacting us at hello@lyrabyddw.com. We may suspend or terminate your access for violation of these Terms or for any other reason with notice.

14. Governing Law

These Terms shall be governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Florida.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
